Judge Posner wrote the opinion. This may come as a surprise, but Posner was appointed to the federal appeals court by none other than Ronald Reagan. However, as the Republican Party shifted further and further to the extreme right, he distanced himself from it. If you can get the audio link that recorded the oral arguments, it is fascinating. Posner politely rips the opponents of marriage equality a new one.
I tend to agree that the next President will be a woman. It will, in all probability, be Jeb Bush v. Hilllary Clinton. My $$$ is on Hillary, just because the Bush name is a gross anathema. If so, the teabaggers will continue to obstruct anything to improve or advance the US. I listen to them scream "I want my country back." Me? I want want my country forward.
Loren, sorry it's taken me so darn long to get back to you about Boehner's lawsuit against the President. You're correct in that I found it...well, not interesting from the standpoint of Boehner...but more of a bad episode of bizarre theater here in the US.
The author of the article in Daily Kos is 100% correct in that federal courts, unlike state courts, are courts of very limited jurisdiction. The only cases federal courts can hear are those enumerated in the US Constitution,an interpretation of a provision of the Constitution, or what what Congress authorizes them to hear.
Here's the real underlying stupidity of this lawsuit. Congress could pass a statute giving federal courts jurisdiction to hear this case. Before it goes into effect, guess what chief executive of the US government has to sign it into law?
The whole thing is nothing more than a propaganda ploy to get the true believers would up like a group of striped nosed baboons in a primate house throwing feces against the wall. The mid-terms should b interesting.
